controversial law that talked about collective controversial rights. the judge says the violent employees constitutional rights. the attorney general jay stephen holland says he will pay for an appeal for the chicago teachers strike enters week two of negotiations, forcing kids out of the classroom for six days. the senate city officials are fighting back, looking to take the teachers courts make them go back to work. steve brown is live in chicago and he joins me now with the latest. steve, reports said that both sides were part of a deal. what happened here? >> we have to keep in mind throughout all of this but there is still, as we speak, both sides helped this. they worked all over the weekend turned into contract language, the unions basic congress on the

house of delegates, got a hold of it yesterday afternoon and decided that they wanted to walk this back to their membership at their local schools before voting on it. there were some things that they didn't like about them and it and they wanted to mull it over. >> he wanted to exercise their democratic process and take the agreement, but still not quite finished in terms of language. it would like to go back to their school. have discussions with members, we will reconvene here on tuesday. >> that is tomorrow or the house of delegates are get together again and maybe vote in this. but it's coming up now. mayor emmanuel decided that he wasn't waiting any longer announced that he was going to seek an injunction to try to force the union back to school. essentially saying it was illegal because it is about noneconomic issues which violates state law and health

and well-being of schoolchildren. the judge was assigned a case decided that it was not an emergency that he made here today. that will be wednesday. so he's pursuing this juncture and it has entered the union. they sent out a press release calling it a vindictive act. the relationship between rahm emanuel in the union wasn't there before and it's a little bit worse today and again, cheryl, there is still a deal on the table. the union has not said no to. not yet. >> it's an interesting deal and we will see you on television tomorrow. steve brown in chicago, covering this for us. chicago students are the biggest losers in this teachers strike. teachers, according to my next desktop only other student's best interest at heart. for now is the ceo of the policy institute, and john, we cannot review that the teachers themselves are really, you know, bad people, but the union leadership turned down a 30% resulted from the city.

what gives here? >> i think what gives is many teachers are excellent teachers, but the mayor is trying to identify the excellent teachers so they can be better rewarded and try to identify those teachers were not doing a good job so they can be removed from the front of the classroom and not have good teachers in their hands. the teachers union come on the other hand wants to remove accountability from the process and that is really what is ultimately at play here. >> what is the benefit of doubt from the u.s. perspective? is the reduced of the jews issue? a complete power grab your? i don't understand them letting this go on. now they will go to court with rahm emanuel come which can be comfortable for anybody. why not just take the deal? >> to be very blunt about it, they fear accountability and unionized schools. the unit has essentially usurped control of the school system away from the public and away

from the chicago public school system. this is aggravated by the fact that kids have not been in school for the second week. most the time it'll never get this kind of strike votes. this is the most radicalized union in the country, it is all about maintaining jobs and that is their business model and when they march, they say schools? our schools. they don't think it's the people school. they don't think it's the children's school. they sure don't think it's rahm emanuel school. they think their school, and they have demonstrated so far that they have the power. cheryl: okay, i think the kids at school or not it should be. >> that is the whole point. >> the key point here is the reason we are in this situation is because the union has all the power and the kurds are completely not at the negotiating table. the parents don't have a seat at the table in its their children and the schools.

and that's what's going on the weight is for the parents agency school choice and more power. >> i want to remind our viewers exactly the numbers we're talking about, we are looking at 74 grand and change. but hours 45 minutes, double that of the most of the rest of the country. superset of chicago citizens students only complete high school. that is a report card and was in the country that would be unacceptable. what the teacher said all this? >> well, to be blunt about it, those are terrible numbers. or attempted to go to school in chicago don't graduate from high school. most of the numbers are horrific in terms of reading and writing and math and science. what the teachers say,hey say that the kids are poor and disadvantaged and that's why you can't hold us accountable. meanwhile, in schools around the country, private schools are taking the same kids and performing exceptionally well. nine of the top 10 schools in the city are charter schools in terms of acp scores and that's

what these teachers are afraid of. they are afraid of the competition from charter schools and and private schools and that's why that is why they are going on strike to prevent accountability. cheryl: you think that the shock on the economy can handle this? >> that's a great question. i think for your viewers in particular, that is important. here's the thing minoans they are working off their deficit reserve this year. next year they face a 1 billion-dollar deficit. over the next two years, $3 billion. what will the money come from? they're going to have the federal government and their bailout from the city and school system or broke. cheryl: john tilman, thank you so much. interesting take. >> thank you for having me on. >> in the streets of chicago to the streets of new york city, we say more than 100 people have been arrested as occupy wall street returned today. protesters blocking to mark the one-year anniversary of the

to get their green card and stick your. >> was specific enough in my? >> he is obviously digging out a huge hole with hispanic who just have gotten the idea that the republican party is hostile. the approach he took today, i don't know whether your work, but he should emphasize the economy. and decide things that he doesn't have a complete hostility to all forms of immigration. i would emphasize how illegal immigrants compete with low skilled immigrants who are native and legal immigrants here in the country. one of the romney seems is increasing people's take-home pay. don't constantly import high school dropouts from mexico. >> at the same time, from a political perspective, is making the right cheesier with hispanic voters? he has long way to go. >> you can't afford these kind of margins. but he also gets the most important thing.

and the president obama from the unemployment rate in latinas as a, higher than the national rate by 12%. 20% increase in hispanic who are on food stamps. all of these things, and he promised he thinks of immigration. the argument he was trying to do -- it was a good idea, but is trying to convert notes for the question is for now. in the hispanic community, they are not enthusiastic because of the economy because they are on the frontlines of paying the price in young people for these policies he is being specific, but for goodness sakes, it's about time. cheryl: rich, you're making a face. >> he is right. if you believe the polls, latino voters care about the economy, much more than they do about immigration. the top issue for everyone else is a top issue for them. just important for rummy to

reasons. they have made progress, but they have a banded attacking obamacare, which is an issue the issue that upper house elected. republicans want to wait from the issue, even after the supreme court decision said it was an attacker to talk about 16,000 irs agents. i will lay a full article saying this is a killer, you and you know what, rummy and the republican establishment have ditched this issue. this was a grassroots issue. let me say this about medicare. that is when the house is in danger today. as i predicted it would be a year ago. on the other hand, the big issue is gallup group today. if you want the government for less government, it is a 20-point margin for less government. the republicans have not made their own case bringing this election on the philosophical grounds -- this is the worst

cheryl: okay, so if i were to ask you what is the greatest security threat facing the nation today, would you say terrorism or perhaps china? what about our national debt? several leaders gathered in washington to assess the impact of america's debt crisis on our national security. certainly in his art laffer and a former economic adviser to president reagan. that was the story today. was that the debt is going to actually hurt our operations overseas. >> yes, i do agree with that assessment in general. a strong economy, with full employment, it is the best

return against any kind of attack for any kind of threat anywhere. the national debt precludes us from having flexibility to really do things we need to do in times of war. imagine if we had a national debt. in 1940 of the levels that we have it now. we would not have been able to carry out world war ii armament buildup. they really would've been bad. cheryl: this is the issue of sequestration. we are talking about the fiscal cliff at the end of year. we had a super super committee, they feel that what they were supposed to do. they knew at the time this -- that they didn't make the cuts that were needed, this would happen. did no one see this coming? >> well, i think they saw coming, but i don't think they believed would happen. i really didn't believe it would happen either. but the sequestration is not the right way to run a government. you cannot do defense spending this day and treat items in the budget equally. some are more important than others and this is not the one you want to.

cheryl: even mike mullen, even he says mrs. a major national security threat with the situation in the middle east now. do you think that congress can come back come back and maybe rethink the facts we shouldn't be cutting half? >> i think that mike mullen is totally correct. he is a phenomenal person under which we still had him as chairman. but, yes, i think they have to come back and really -- look at the middle east and all the issues we have facing us. not only in the middle east and russia and china and the rest of the world, we have extended our defense sutures out way beyond our resource base. i think that we need to rethink our defense spending and even more so, we really needto rethink getting our economy growing again to provide prosperity the can give us the type of defense that we need. cheryl: let me ask you this.

you have bernardi givest quantitative easing. i'm curious what you make of that move. he seems to be more than anyone, so concerned about being that money -- the printing of the money flowing. did you agree with the decision last week? >> no, i don't, it's really silly and foolish. there is a great piece in "the wall street journal" by john taylor and george shultz and john kogan and a few others. but billy outlined by ben bernanke has been a foolish thought. it hasn't worked. we've had three quantitative easing his and one "operation twist", and we are still in rotten shape. ben bernanke has done nothing to make today's economy better, and he has done a lot to make future economies a lot worse. >> one of the things that he has done, and this could be a positive sign, keeping interest rates low, the rebounding of the

housing market. at the same time, at the same time, jobs are being created. we still have no job creation. that can't print jobs. what could he do on the unemployment line? >> lower interest rates, we have had lower interest rates for five years now. the housing market hasn't got much better. i think what's happening is we get a couple new ones though. we are way below the levels that we should be. there is no boom in the housing market, there are no jobs. and ben bernanke has not been successful. the book we have done is we have built up a huge national debt that we will have to live with in the future. that is when you're going to see

the deficit with china has more than doubled. it is now almost $350 billion a year. it is costing america three to 5 million jobs. it is a terrible situation, and that's mr. obama's fault. >> one of the things that mitt romney cannot sing, he said this president is failing to confront china's trade practices. yoakam he also has been vocal about the issue of protection of our patents. the chinese have had complete disregard for u.s. intellectual property. you think anybody is going to change? >> well, i think that if mr. romney became president, there is a chance it would change. we know that what mr. obama's president, it certainly is not going to change. especially with his close relationship at silicon valley. companies like apple, they have to invest in china, establish r&d in china. in order to sell this, to get some protection, then they become apologists for china. the worst offender when it comes to this is general electric that

is chaired by the president's chairman of the jobs committee. you know, he took stimulus money. are you ready for the. >> know what he got the towers from? he got from a military contractor in china that was owned by the chinese government. >> they can do it cheaper and that's the whole reason why. >> it was a subsidized contract. it was chinese pol it was chinese policy to maintain their contract. he complains that romney doesn't walk the walk. so he gives money to build windmills that are really needed china. >> all right, look, i know you agree with mr. romney when it comes to getting tough on china. at the same time, the markets do, as you know, depend on growth of china. and they have had a little to the slowdown this year. is that concern into the u.s. economy?

center. this is a bad deal. this is a bad deal for the taxpayers, of course, treasury said no to it. >> they have been saying no. but they could have had share prices over $30 per we heard the same story. they're not going to sell at a loss for the factors they should get out of the auto industry and they should've done it as soon as possible. it is based on politics. tim geithner worked for goldman sachs and he knows that a decision to sell stocks should it be based on what you pay for the stalkers should be based on whether you can own the stock this time. right now, the government shouldn't own general motors stock. they should sell as soon as possible from the should've sold almost a year and half ago. when the value is up about 20% higher than it is now. taxpayers have seen losses of about $6 billion, about $3 billion more since that time, and we heard the same story

cheryl: in focus tonight, the new iphone five. at&t saying that it has sold out all of their iphone five owns but did not release exact numbers. that is just the pre-orders online. the iphone five is officially on sale this friday. is it a blockbuster or is apple doing what he does best? how could at&t be sold out of one of the most insignificant products this year. >> you know, how is it that apple may be the best one company in the world and could get those demanding so wrong? the iphone five isn't even out

yet and already the first wave of this smart phone is sold out. apple said its mold and 10 sold more than 2 million in just 24 hours. that is better than doubled the first orders of the predecessor, 4-s. stopping short of giving us any proof of numbers. wait a minute. why not have 1 million units ready and so the 2 million? is apple really that clueless or might they be creating a product shortage intentionally to stoke a purchasing panic for the product? apple put out a statement this morning, they were not all that contrite about the snafu, saying that iphone pre-orders have shattered the previous record held by the iphone for model. they say they're forecasting demand and matching the manufacturing, apple is simply

too hungry to ever leave sales on tap and on the table. to be sure, this is the broadest iphone rollout. they will be in nine countries next week, another 22 countries a week later, and most major carriers, have them from the get go. now, apple has one more chance to get right on the supply and demand equation, next month, when it is expected to unveil the new ipad. cheryl: okay, they do so much from agendas. it is also worth noting that apple stock went to a new high. there is the software you. it is not just teachers they can't seem to come to an agreement. the national hockey league says that they are not going to bargain with the players union. it will be the third lockout of the major sports league in less than two years.

the nfl started the season with no hiccups, but if you want a front row seat, you have to shell out a lot of money. and tonight's top five list on the most expensive nfl tickets still to go for the season. number five is the greenbrae packers at the seattle seahawks next week's monday night game going for $407 per ticket. number four, a rivalry matchup between the packers and the chicago bears. it could be a game changer since it will be happening so late in the season. tickets are $432. number three, the packers at houston texas stadium. seeing them face-off will cost you $434. number two is quarterback showdown, peyton manning and the denver broncos taking on tom manning and the new england patriots. it's also in october, $467 per ticket. and the number one most expensive nfl ticket for the season is the pittsburgh steelers versus dallas cowboys.
